so my bf's bm's lawyer has gotten a continuance for her contempt charge for over 9 months now. It seems like the court is going to let her get off from not letting my bf see his son. I must admit that she does let him see him now, but still sends CPS to our house every month.
Also her lawyer is trying to change his child support order. My bf works 10 hrs a week for $12/hr. He is now disabled from an accident and is lucky he even works at all. they are trying to make the courts figure his child support as 40 hours a week at $12 an hour. They are trying to make is wages seem like near $2000 a month instead of only $480 a month he actually gets. If the judge actually allows this then his whole pay check would go to child support and he would not be able to support our family at all. We have a child together too. And it shouldn't be only my responsibility to support our child while his BM gets everything from him. Am I being selfish?

Unfortunately depending on the state that you are in yes, they can. When someone who already has children is ordered to pay child support some states don't consider your new children. They look at as a choice you made on your own. You all don't have money for a lawyer it sounds like but I would do what ever it takes to earn extra income to get one ASAP. I don't think you are being selfish but you may be a little naive to the child support laws. They don't really run in favor of anyone but the state and the single mother

If BF is disabled he should contact Legal Aid for help. It sounds like he qualifies. Don't know what state you are in but he should have been asked for his most recent pay stubs. Your state may not consider subsequent children but they can't squeeze blood from a turnip. If he dont have it, he don't have it.

They will go by his income. Your kids r looked into, but not for a decrease in child support, just not an increase either. They won't leave u with nothing
