So BM misses pickup from my SD school AGAIN! This is the 4th time in the last 3 months. We pick my SD up from school and take her home. BM proceeds to show up at my residence demanding that DH and I bring my SD outside to her. My DH called the authorities to handle the situation and remove BM from our property. Since it was her weekend, and she showed up DH and police escorted my SD outside to BM. We did not press charges, but she was informed that if she does it again she will go to jail. Now my SD said she asked BM why the police were there, to which she replied "I don't know", which leaves DH and I to explain this mess to a 6 year old.
The very next Friday she calls 45 minutes before my SD gets out of school and says she wants to send her brother to pick her up. Note that this is after she tried to call my SD school and they told her no already. The school does NOT allow anyone other than DH, BM, and I to remove my SD from the premises. DH calls the school and they agree, just this once, since I was at the hospital and DH was at work and would not be able to make it in time to get her. BM brother was required to go into the office and show ID in order to pick up my SD. Instead BM brother sends his girlfriend to pick up my SD!
Now there is a statute we decided to add into the visitation agreement. If the NCP is (x) minutes late they forfeit visitation for said period. We asked BM if she agreed so that we could avoid the courts and she feels that we are being extreme to deny her visitation if she doesn't show up to pick up my SD from school on Friday. My opinion is that the statute means nothing as long as you are on time to pick up your child. I am not responsible to make sure your visitation occurs if you do not fulfill your obligations to pick my SD up. How is that extreme?
Our custody agreement states that before we go in front of the judge we must attend mediation. Appointment has been set. I have been requested by BM and DH to participate in mediation as the primary caregiver for my SD. If I decline it reflects poorly on DH in court and looks as though I am unwilling to cooperate, so I accepted.
I KNOW that there is no way she can fight our request since it is the law. We aren't even asking that her time be cut, just that she show up on time, and if not, she cannot expect us to rearrange our schedules to meet her at a different time without prior notification.
I am curious as to what I can expect from this mediation session? Has anyone ever attended one before?
