Okay....Im with a man who a has a BM who is pretty much nuts. I can go on forever about her. They have been broken up for over 5 years and she is with someone else and has a 3 year old daughter with her man yet she still wants to wants to have control of my man and makes our lives miserable. She has gone to the extent of showing up at my job to harass and threaten me because me and my man got into an altercationwhile the child was in my house. Anyway Before me and him got together she took him to court for CS even though he was giving her money everyweek and has the checks to prove it. She brought in false statements saying that she was paying for the childs healthcare and paying for childcare fees. Which is why he is paying a ridiculous amount of $165 a week for one child. It has come to my attention that the child is on medicaid and she receives childcare subsidies from the state meaning she is not paying for healthcare or childcare. I told my boyfriend to make a copy of his sons medicaid card when she had him take him to a drs appointment Does anyone know if he brings this to court will they even look into this or take any action?

To my knowledge, if the BM is getting Medicaid, most states are required to refer the cases to CSE. Someone has to repay the state for the medical cost.

But the money he is paying for health care and child care is going in her pocket not to the state and mean while she is getting assistance from the state for both of those things.

It is my experience that if the custodial parent gets subsidies from the state, when the non-cusotidal parent pays CS the state takes their cut before giving the custodial parent the rest of the payment. It may be that the BM is not actually receiving the full amount of what your BF is paying.
